1. Assertion of Rights

3.1 Commercial Use — License Required

Strictly Prohibited without a Paid License.

Any commercial use of content from this Site is strictly prohibited unless a valid, paid license is obtained in advance. “Commercial use” includes, but is not limited to:

  • 3.1.1 Republishing content on monetized blogs, websites, or news aggregators.
  • 3.1.2 Using code snippets or data in proprietary software sold or licensed to third parties.
  • 3.1.3 Training Artificial Intelligence (AI) or Machine Learning (ML) models.
  • 3.1.4 Use in marketing, promotional, or advertising materials.
  • 3.1.5 Inclusion in reports, white papers, or publications distributed for commercial gain.
  • 3.1.6 Any use that generates direct or indirect revenue.

3.2 Personal & Educational Use — Limited License

A limited, revocable, non-exclusive, non-transferable license is granted for personal, non-commercial transitory viewing only. Under this limited license, you may:

  • 3.2.1 View pages on this Site within a standard web browser.
  • 3.2.2 Print or download extracts for your personal, private, non-commercial use only.
  • 3.2.3 Share links to content on social media, provided that alser.ca is clearly and prominently cited as the source.

This limited license does not permit you to:

  • Modify, adapt, or create derivative works from any content.
  • Use any content for any commercial purpose whatsoever.
  • Remove or alter any copyright, trademark, or proprietary notices.
  • Transfer this license to any third party.

This limited license may be revoked at any time, at the sole discretion of the site owner, without notice.

4. Fair Dealing Exceptions

In accordance with Section 29 of the Canadian Copyright Act, limited use of copyrighted material may be permitted without a license solely for the following statutory “Fair Dealing” purposes:

  • 4.1 Research
  • 4.2 Private Study
  • 4.3 Education
  • 4.4 Parody or Satire
  • 4.5 Criticism or Review (requires clear attribution to alser.ca)
  • 4.6 News Reporting (requires clear attribution to alser.ca)

Note: The “Fair Dealing” exception is narrow and is not a blanket right to copy. Whether a use is “fair” depends on the purpose, character, amount, alternatives, nature, and effect of the dealing. Any use falling outside these narrow statutory exceptions constitutes copyright infringement, regardless of intent.

5. Moral Rights Assertion

Pursuant to Section 14.1 of the Canadian Copyright Act, the authors of alser.ca strictly assert their Moral Rights:

  • 5.1 Right of Attribution: The author has the right to be identified and credited for their work. Any licensed or fair dealing use must clearly attribute the author by name with a link to alser.ca.
  • 5.2 Right of Integrity: Content must not be distorted, mutilated, modified, or used in association with any product, service, cause, or institution to the prejudice of the author’s honor or reputation.

Moral Rights cannot be waived or transferred and survive any license agreement.

6. Prohibition on AI Training & Automated Scraping

Except as permitted by law, no content or information from this Site may be used to train, fine-tune, or evaluate artificial intelligence systems, large language models, or machine learning models without express written permission and a paid license.

Automated scraping, crawling, or harvesting of this Site—whether for dataset creation, competitive intelligence, price monitoring, or any other purpose—is strictly prohibited without a written agreement with the site owner.

Violation of this section will be treated as commercial copyright infringement and pursued accordingly.

7. Enforcement & Remedies

The site owner reserves all rights to enforce copyright under Canadian law, including but not limited to:

  • Seeking injunctive relief to stop unauthorized use immediately.
  • Pursuing statutory or actual damages as provided under the Canadian Copyright Act, which may include damages of up to $20,000 per work for commercial infringement.
  • Reporting infringement to relevant platforms, hosting providers, and search engines for content removal.

8. Notice and Notice Regime (Infringement Claims)

If you believe your work has been copied on alser.ca in a way that constitutes copyright infringement, please provide a formal notice in accordance with the Canadian Notice and Notice regime (Copyright Act, ss. 41.25–41.26).
